Terms and conditions of the "Hack Your Life" online shop

1. General information

1.1. The online shop "Zhakuj Życie", operating at the address: https://zhakujzycie.com (hereinafter: "Shop"), is run by a non-business natural person:
Joanna Uśmiał-Terebelska, correspondence address: PO Box 14, 61 Aleja Jana Pawła II Street, 01-039 Warsaw, e-mail address for contact: kontakt@zhakujzycie.com.

1.2 The seller conducts non-registered sales on the basis of Article 5(1) of the Entrepreneurs' Law of 6 March 2018.

1.3 These Terms and Conditions set out the rules for the use of the Shop, placing and processing of orders, payment, withdrawal from the contract, returns, complaints, protection of personal data, copyright and amendments to the Terms and Conditions.

1.4 The Buyer accepts the Terms and Conditions by placing an order in the Shop.

2 Offer and products

2.1 The objects of the sale are:

  • printed books,
  • ebooks in PDF/EPUB/MOBI formats,
  • sets (book + ebook).

2.2 All prices listed on the website are gross prices, expressed in Polish zloty (PLN).

2.3 The seller reserves the right to change prices and availability of products without prior notice, which does not affect orders placed earlier.

3 Placing orders

3.1 Orders can be placed via the form available on the Shop's website.

3.2 The prerequisite for the fulfilment of the order is the provision of correct contact details and payment of the order.

3.3 The customer receives an e-mail confirming that the order has been accepted for processing.

3.4 The ebooks are sent automatically or manually to the e-mail address provided by the customer.

4 Payments

4.1 Available forms of payment:

  • bank transfer,
  • online payments (e.g. Przelewy24, BLIK).

4.2 Failure to make payment within 7 days will result in cancellation of the order.

5. invoices and sales documents

5.1 The seller does not issue VAT invoices as he is not in business.

5.2 At the request of the Customer, the Seller shall issue an invoice confirming the sale.

5.3 The customer receives a confirmation of the purchase by e-mail.

6 Implementation and delivery

6.1 Printed books are dispatched within 7 working days of receipt of payment.

6.2 Delivery takes place via the Polish Post or courier companies. The cost of delivery is stated when placing the order.

6.3 The ebooks are sent to the customer's e-mail address immediately after payment is credited.

7 Right of withdrawal

7.1 The consumer has the right to withdraw from a distance contract without giving any reason within 14 days of receiving the product.

7.2 In order to exercise your right of withdrawal, you must send an e-mail to: kontakt@zhakujzycie.com, stating the order number and contact details in the body.

7.3 Only physical products (books) can be returned. Ebooks are not returnable once they have been delivered electronically if a download has been initiated - in accordance with Article 38 of the Consumer Rights Act.

7.4 The cost of returning the product shall be borne by the consumer, provided that the consumer was informed of this when placing the order. The Seller does not accept cash on delivery.

7.5 Payment shall be refunded within 14 days of receipt of the returned product.

7.6 Model withdrawal form

The consumer may use the model withdrawal form below, but this is not obligatory.

8 Complaints

8.1 Complaints can be submitted to: kontakt@zhakujzycie.com.

8.2 The complaint should include: name, order number, description of the problem and, if possible, photographs of the damaged product.

8.3 The Seller shall consider the complaint within 14 days.

8.4 The consumer has the right to lodge a complaint on the basis of the warranty for defects in the goods (Civil Code).

8.5 Complaints are dealt with in accordance with the regulations:

  • Act of 30 May 2014 on consumer rights (Journal of Laws 2023, item 2759, as amended),
  • Act of 23 April 1964. - Civil Code (Journal of Laws 2023, item 1610, as amended),
    in particular Articles 556 to 576 of the Civil Code concerning the seller's liability under warranty for defects.

9 Data protection and cookies

9.1 The administrator of the personal data is Joanna Uśmiał-Terebelska.

9.2 Customers' personal data shall only be processed for the purpose of processing the order, contacting the customer or - with separate consent - sending the newsletter.

9.3 The rules for the processing of personal data and the use of cookies are set out in the Privacy Policy available on the Shop website: https://zhakujzycie.com/polityka-prywatnosci/.  

10 Newsletter and Customer Account 

10.1 The customer may voluntarily subscribe to the newsletter. In this case, his or her e-mail address will be used exclusively to send commercial information. 

10.2 Subscription to the newsletter requires the Customer's express consent to receive commercial information by electronic means within the meaning of Article 10(2) of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2020, item 344, as amended) and Article 172(1) of the Act of 16 July 2004. - Telecommunications Law (Journal of Laws of 2022, item 1648, as amended). Consent is voluntary and may be withdrawn at any time, without affecting the lawfulness of the data processing performed before its withdrawal. Withdrawal of consent is possible by clicking on the "Unsubscribe" link in the newsletter message or by contacting the Administrator at: kontakt@zhakujzycie.com

10.3 The Shop may provide a "Customer Account" function to view order history and edit data. The customer can request the deletion of the account at any time.

10.4 The legal basis for the processing of personal data for the purpose of sending the newsletter is the Customer's consent (Art. 6(1)(a) RODO).

11 Copyright

11.1 All content available in the Shop, including text, images, graphics, product descriptions and ebooks, is protected by copyright and belongs to Joanna Uśmiał-Terebelska or the respective authorised entities.

11.2 Copying, distribution or use of this content without the author's consent is prohibited.

12 Final provisions

12.1 These Terms and Conditions shall be effective as of the date of publication on the Shop website.

12.2 The Seller reserves the right to change the Terms and Conditions. Customers will be informed of the change by an announcement on the main page of the Store or by e-mail (for those subscribed to the newsletter) at least 7 days before the change comes into effect.

12.3 The amendments do not affect orders placed prior to their entry into force.

12.4 In matters not covered by these Terms and Conditions, the provisions of Polish law, in particular the Civil Code and the Consumer Rights Act, shall apply.

12.5 The Seller informs that it does not use out-of-court means of dispute resolution within the meaning of the Act of 23 September 2016 on out-of-court resolution of consumer disputes.
At the same time, the Consumer has the possibility to use the online platform ODR (Online Dispute Resolution) available at: https://ec.europa.eu/consumers/odr.
